1. The Client's Situation

A domestic company specializing in sporting goods, while launching a new product, planned a packaging design that utilized a particular image and color combination familiar to consumers. Because that design contained elements that could evoke a specific organization or brand, concerns were raised that using it might give rise to legal risks such as copyright infringement, design right infringement, and violation of the Unfair Competition Prevention Act.
