1. The Client's Situation
In preparing to file an application for pre-litigation conciliation (jesojeon hwahae) in order to prevent a lease dispute in advance, the client requested support, citing the complexity of the list of documents that had to be submitted. In particular, the documents to be prepared by the lessor and the lessee differed from each other, and the documents required varied depending on whether the party was a corporation or an individual, causing confusion in practice. In addition, since each court might request additional documents, an overall organization of the matter was needed.
2. Your Legal Team's Advisory
Your Legal Team systematically organized the documents basically required when applying for pre-litigation conciliation, classifying them by lessor/lessee and by corporation/individual. For all documents, we clearly informed the client of the requirement that they be issued within the most recent three months and of the possibility of additional submissions depending on the court, minimizing practical confusion. We also organized the documents so that they could be managed in the form of a submission checklist, enabling the client to apply without omissions.
3. Result
The client was able to accurately prepare all the necessary documents and to proceed with the procedure stably during the pre-litigation conciliation application, without any request for additional supplementation. The client thereby gained the benefit of minimizing the time delays and cost consumption that can arise at the document-preparation stage.
